- The Security industry is strictly regulated by the Private Security Industry Regulatory Authority (PSIRA).
- All security related entities and their operational staff are legally obligated to register with PSIRA (even locksmiths)
- There are literally thousands of security companies in South Africa, and many of them are operating illegally by not registering with PSIRA.
- There are hundreds of thousands of security guards employed in South Africa and many of them are not registered with PSIRA. which is illegal ( some are aliens, some are even criminals).
- Wages paid to security personnel are laid down annually in terms of the appropriate Wage Determination Act.
- It is illegal for any company (even if it is not a security company) to employ personnel in a security function without themselves registering with PSIRA, and employing only PSIRA registered guards.
- Any company employing the services of a security company is liable for a hefty fine if the security company they hire (or their guards) are not paid up members of PSIRA.
- It is up to you to check up on the credentials of your intended service provider before engaging. The customer can be held responsible for the sins of the security provider.
- It is therefore most important that potential clients of the security industry are aware of the controls and legalities in place, which are monitored by PSIRA, and that they check the credentials of any Security provider before engaging them, or stand the risk of a hefty fine.
- In the light of the above, it is also imperative to be extremely wary of security companies quoting low prices for their services. If it seems to be good to be true - it probably is.
- From a legal point of view, remember that ignorance of the law is not an accepted excuse, and won't stand up in court.
